This note contains the terms and conditions governing the www.calzuro.it website. The use of its content will imply the acceptance of all the provisions in this document. All product purchases made via the www.calzuro.it website are governed by the above-mentioned general conditions as well as by the other provisions and operational instructions contained in the site. In case of conflict between the above-mentioned provisions and instructions and the general conditions, the latter shall prevail. We ask purchasers to read these general conditions carefully. GESTIONIONLINE.NET (hereinafter called the Seller), having its registered office in Via Panà 56 A,
35027 Noventa Padovana (PD) - Italy, deals exclusively with the management of the Calzuro e-commerce sales and transactions, that is orders, sales, deliveries of the goods and other related activities. Bihos S.r.l. retains the right to modify, at any time and without notice, the contents of the site (i.e. prices, photos). Any modifications shall be valid from the day they are published.
These General Conditions of Sale govern the relationship between GESTIONIONLINE.NET and the Customer with regard to the purchase of Products via this site. For anything not expressly specified in these General Conditions of Sale, please refer to the provisions of Decree-Law No. 185 of 22 May 1999 and the applicable Civil Code. Conclusion of the Contract:
The Seller's receiving of the order confirmation, complete in all its parts, sent electronically by the Customer, determines the conclusion of the Contract. With the conclusion of the Contract, the Seller undertakes to supply the Customer with the products, at the terms and conditions provided for in these General Conditions of Sale, without prejudice to the right of not fulfilling orders by customers not giving enough guarantees of solvency. By sending the order confirmation, the Customer unconditionally accepts and undertakes to comply, in all its relations with Bihos S.r.l., with the provisions of these General Conditions of Sale as well as any further information contained in the web pages of the site. The amount of the order will be debited at the exact time of purchase.
The images on the site are just a representation that normally corresponds to the product, however Bihos S.r.l. gives no warranty as to the exact correspondence of the image shown, the colour resolution of the images can vary according to the monitor used. All the prices of the products are clearly shown in the site and include VAT. They do not include any further or different tax or duties levied by the relative applicable legislation, such as those provided for in case of imports. In these cases therefore the Customer must clear the goods and pay the relevant duty and tax (other than VAT) that he/she might owe in the Country of importation. The unavailability of the products will be communicated at the moment of the online purchase request.
Payment in performance of the Purchase Contracts agreed on via the site can be made by credit card, PayPal, Stripe, Postepay and bank transfer.
If the Customer proceeds in purchasing the products, the financial details are sent to the relative bank that, by cryptographic protocol, will guarantee data confidentiality, immediately check the credit card validity and debit the total amount of each purchase contract straight away. In order to execute the Contract, the Seller reserves the right to ask the Customer, at any time, for additional information (i.e. land telephone number) or the forwarding of a copy of the documents proving ownership of the credit card used. If the Customer does not forward the requested information or further documentation, the Seller reserves the right to reject the order or withdraw from the contract, informing the Customer by using the email address provided.
5 DELIVERIES AND DOCUMENTATION
Shipment of the parcel is normally carried out within 5 working days from the receipt of payment. Small delays due to order build-up are possible. Shipment is by courier. Delivery times and forms vary according to region/country. The relative fees are specified below:

Times are approximate and vary according to the country of destination.
Traceability: The Customer will receive an e-mail with the courier's notification of shipment for traceability's purpose.
Storage: The courier will try to deliver the package twice, after that it will go into storage.
Therefore we ask you not to place orders if you are not certain that you will be able to accept or collect the package from storage personally (or via proxy).
When the package goes into storage, you will have to collect it from the courier's at the address stated on the note that will be sent to you.
On placing the order, please fill in the fields carefully: telephone number, delivery address and times.
Please specify the exact delivery address and addressee/company name, otherwise GESTIONIONLINE.NET on behalf of Bihos S.r.l. will not be held responsible and any additional shipping costs will be debited to the Customer.
If the package is not collected, except when due to courier's proven negligence, GESTIONIONLINE.NET on behalf of Bihos S.r.l. reserves the right not to fulfil orders placed by customers that have rejected previous deliveries. GESTIONIONLINE.NET on behalf of Bihos S.r.l. is anyway not responsible for any delays.
6 CANCELLATIONS / RETURNS
The Customer has the right to cancel the Contract of Purchase for whatever reason, without having to give any explanation and without penalties, subject to compliance of the following procedures within fourteen (14) working days.
To exercise the right of withdrawal, the Customer must send a written communication, within the term stated, to the address below, via registered letter with acknowledgement of receipt. The Customer can inform the Company, within the same term, via the "Contacts" area, on condition that the cancellation is then confirmed via registered letter with acknowledgement of receipt within the following forty-eight (48) hours.
Returns must be paid by the Customer, by sending the products via a courier of their choice. The products must be sent no later than fourteen (14) working days from the delivery date, to the following address:

In order to exercise the above-mentioned right of withdrawal correctly, the Customer must comply with the following conditions: the withdrawal can also be applied just to individual products being part of only one contract of purchase, without prejudice to the fact that the withdrawal applies to the whole product, that is the Customer cannot withdraw just one part of the individual product purchased.
The only expenses the consumer owes for exercising his/her right of withdrawal pursuant to art. 5 of Decree-Law No. 185 of 22/05/1999 are the direct expenses to return the goods to the sender.
The Seller will refund the value of the goods purchased but not the shipping cost.
If the product returned was damaged during transport, the Seller must inform the Customer about it so that he/she can promptly file a complaint and claim against the courier (and/or the relative insurance company).
GESTIONIONLINE.NET on behalf of Bihos S.r.l. is in no way liable for any damage, theft or loss of the products being returned; the risk always stays with the Customer.
In any case of non-compliance with the above-mentioned conditions and methods to return goods as well as in case of damage to the products due to causes other than transport, the Contract of Purchase shall be valid and effective. GESTIONIONLINE.NET will send the unlawfully returned products back to the Customer, debiting him/her with the relative shipping costs.
7 INTELLECTUAL PROPERTY RIGHTS
All trademarks (both registered and not), as well as any and every product of the intelligence, distinctive sign or name, image, photo, written text or graphic and more generally any other intangible asset protected by international laws and conventions with regard to intellectual and industrial property reproduced on the website remain the exclusive property of Bihos S.r.l., without the Customer having any right on them for accessing the website and/or entering the Contract of Purchase. Any use, even partial, of the same is prohibited without the previous written authorization of Bihos S.r.l., to whom all relative rights are exclusively reserved.
8 WARRANTY IN CASE OF FAULTY PRODUCTS
Pursuant to art. 130 and 132 of Decree-Law 206/2005, Bihos S.r.l. is liable towards Consumers for any lack of conformity in the products existing at the moment of delivery, with particular regard to faulty or damaged products for a period of two (2) years from delivery.
Cases of normal wear and tear and any other case attributable to the Customer's misuse of the product will be excluded.
All Consumer's rights attributed to him/her by art. 130, paragraph 2 of Decree-Law 206/2005 are waived if GESTIONIONLINE.NET is not notified about the lack of conformity within two (2) months from the date when the fault was discovered.
Please note that the complaint in respect of the defects must be sent in writing (via registered letter with acknowledgement of receipt) and accompanied by accurate documentation, even photographic.
Bihos S.r.l. will make its best to replace, at its cost and with other products of the same quality and type available from its stock, those products that are damaged or faulty, on condition that they have been returned by the Customer in their original packaging (complete of all its parts). If replacement with the same product is not possible (for instance because the product is no longer in the catalogue), the amount paid for the faulty product will be refunded to the Customer.
9 COMMUNICATIONS AND COMPLAINTS
All Customer's communications and complaints about GESTIONIONLINE.NET with regard to the contracts of purchase must be sent via email in the "Contacts" area, choosing the appropriate request.
10 TREATMENT OF PERSONAL INFORMATION, PRIVACY
11 JURISDICTION / APPLICABLE LAW
Users visiting the www.calzuro.it website accept to submit to the jurisdiction of the Italian law. For any legal dispute, pursuant to the existing regulations, the competent Court is the one where the Consumer lives, for any other user Padua's will be the competent Court (art. 1469 bis No. 19 of the Civil Code).
